Terms of Service

1. Agreement
These Terms of Service ("Terms") constitute a legally binding agreement between you ("Customer", "you") and Skyie Global InfoTech Ltd("Senthop", "we", "us"), a company registered in England and Wales (number 17294509), with its registered office at 1 Surjit Court, 259 High Street, Rochester, United Kingdom, ME1 1HZ.
By creating an account or using our services, you agree to be bound by these Terms. If you are entering into these Terms on behalf of a company, you represent that you have the authority to bind that entity.
2. Services
Senthop provides email infrastructure services including: SMTP relay, transactional email delivery, email marketing tools, inbound email processing, deliverability analytics, domain warmup, and related APIs and SDKs ("Services").
We reserve the right to modify, suspend, or discontinue any part of the Services with 30 days' notice for material changes.
3. Account registration
You must provide accurate and current information when creating an account. You are responsible for maintaining the confidentiality of your credentials, including API keys.
You are responsible for all activity under your account. Notify us immediately at [email protected] if you suspect unauthorised access.
4. Acceptable use
You agree not to use the Services to:
- Send unsolicited bulk email (spam)
- Send emails to purchased, rented, or harvested lists
- Send phishing, malware, or fraudulent content
- Violate CAN-SPAM, UK PECR, EU ePrivacy, or any applicable anti-spam law
- Send content that is illegal under UK law
- Impersonate another person or entity
- Attempt to circumvent rate limits, warmup schedules, or sending restrictions
- Interfere with or disrupt the Services or other customers' use
We may suspend or terminate your account immediately for violation of this section.
5. Sending practices
You must comply with all applicable email regulations. You must:
- Have a lawful basis for emailing each recipient
- Include a functioning unsubscribe mechanism in marketing emails
- Include a valid physical postal address in commercial emails
- Honour unsubscribe requests within 48 hours
- Maintain your own suppression list and respect ours
- Not send to addresses that have hard-bounced
6. Service levels
We target 99.9% API uptime measured monthly. Current status is at our status page. Email delivery is subject to recipient server availability and reputation factors outside our control. We do not guarantee delivery to any specific inbox.
7. Billing and payment
Paid plans are billed monthly or annually in advance. All prices are in GBP and exclusive of VAT unless stated. Payment is processed by Stripe. Failed payments may result in suspension after 7 days' notice.
You may cancel at any time. Cancellation takes effect at the end of the current billing period. We do not provide refunds for partial periods.
8. Data processing
When you send emails through our platform, we act as a data processor under UK GDPR. You remain the data controller. See our Privacy Policy. Enterprise DPA available at [email protected].
9. Intellectual property
We retain all rights in the Services. You retain all rights in the content you send. You grant us a limited licence to process your content solely to provide the Services.
10. Limitation of liability
Our total liability shall not exceed the fees paid by you in the 12 months preceding the claim. We shall not be liable for indirect, incidental, special, consequential, or punitive damages.
Nothing in these Terms excludes liability for death or personal injury caused by negligence, fraud, or any liability that cannot be excluded under English law.
11. Indemnification
You agree to indemnify us from claims arising from: (a) your use of the Services in violation of these Terms, (b) your violation of applicable law, (c) your email content, or (d) disputes between you and your recipients.
12. Termination
We may suspend or terminate access if you breach these Terms, your use poses a security risk, payment is overdue beyond 30 days, or required by law. Upon termination, your data is available for export for 30 days, then deleted per our Privacy Policy.
13. Changes
Material changes communicated via email at least 30 days before taking effect. Continued use constitutes acceptance.
14. Governing law
These Terms are governed by the laws of England and Wales. Disputes are subject to the exclusive jurisdiction of the courts of England and Wales.
